Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 306/34 of the Indian Penal Code.
The prosecution case is that the informant's widow daughter-in-law had illicit relationship with her neighbour Dhansi Sharma when villagers called for a Panchayat and in the Panchayat the widow daughter-in-law of the informant and Dhansi Sharma were ordered to pay Rs. 11,000/- and both were directed to marry. Consequently Dhansi Sharma refused to marry with the widow daughter-inlaw of the informant, as a result, she committed suicide. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.35563 of 2015 (2) dt.20-08-2015 2/2 petitioners that there is nothing on record to suggest that petitioners were members of the Panchayat and even assuming the accusation, no offence under Section 306/34 of the Indian Penal Code is made out against the petitioners. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Supaul in connection with Pipra P.S. Case No. 77 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
