This application, for grant of anticipatory bail, arises out of S.C. No. 991 of 2016 arising out of Complaint Case No. 1006-C of 2015, disclosing offences under Sections 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner has submitted that the parties have settled their dispute by way of mediation before the Mediator vide Mediation Proceeding No. 179 of 2017, which is evident from the mediator's report at flag-M to this application. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.1832 of 2017 (3) dt.04-07-2017 let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub- Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with S.C. No. 991 of 2016 arising out of Complaint Case No. 1006-C of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
