JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 This application, for grant of anticipatory bail, arises out of Sugauli P.S. Case No. 161 of 2019, disclosing offences under Sections 420 of the Indian Penal Code and Section 36/35 of the Copyright Act.
Prosecution case as per the F.I.R. lodged by the manager of IIRIS Company is that the informant got the information about the sale of spurious product of the company and, then, he complained to the Agriculture Officer, who constituted a team and on search from the shop of the petitioner, some bottles containing 60 ML and 150 ML insecticide was found and further 7 pieces containing 150 ML medicine and 7 pieces containing 60 ML medicine in 03 bottles was also recovered, containing the symbol of company of the informant Submission of learned counsel for the petitioner is
Patna High Court CR. MISC. No.54608 of 2019(2) dt.30-08-2019 2/2 that he has falsely been implicated in this case. Moreover, a very small quantity of insecticide has been found from the shop of the petitioner and he is ready to abide by any condition imposed on him.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, East Champaran, Motihari or the court, where the case is pending, in connection with Sugauli P.S.
