2. The petitioner apprehends his arrest in connection with Phulwariya P.S. Case No. 276 of 2022 registered for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, in brief, is that while on patrol, the police signaled a Bolero car to stop, but two persons got down and fled. On searching the vehicle, the police recovered 392.76 liters of foreign liquor from the seats and dickey. A local informant identified the absconding persons as Tiger Yadav and Chintu Ansari. A seizure list was prepared, and an FIR was lodged.
4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced on the basis of secret
Patna High Court CR. MISC. No.65999 of 2025(2) dt.24-09-2025 2/3 information which is said to have been received by the Police whereas this petitioner is in no way connected or related with the seized articles as well the Bolero Jeep bearing Registration No.BR011PE9780. It has further been submitted that the Police intercepted the vehicle and lodged the instant case under the Phulwariya Police Station while the petitioner is a resident under Bhorey Police Station. It has next been submitted that the petitioner has one criminal antecedent but the offence is not of similar nature and he is on bail in the said case.
5. Learned APP for the State opposes the prayer for anticipatory bail application.

Regard being had to the submissions made by the parties, taking into consideration the fact that nothing was recovered from the conscious possession of the petitioner and his name has transpired on the basis of secret information, accordingly, I am inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of
