Petitioner apprehends his arrest in Madanpur P.S. case no. 125/18 instituted for the offence under Section(s) 409,420 and 406/34 of the Indian Penal Code.

It is alleged in the written report that as per order of the District Magistrate, Aurangabad a team was constituted to enquire the Kasturba Gandhi Balika Residential School about the money which has been misappropriated in the said school. After enquiry, it was found that for the financial years 2015-16 to 2017-18 Rs. 54.50 lacs has been allotted and Rs. 52.98226

Patna High Court Cr.Misc. No.40821 of 2018(5) dt.27-08-2018 2/3 lacs has been spent but no bill of expenses on demand has been produced and money has been misappropriated and embezzled by the accused persons.

Learned counsel for the petitioner has submitted that one Sarita Kumari was warden and custodian of the documents. The responsibility of running and looking after the aforesaid residential school was of the warden.

A supplementary affidavit has been filed on behalf of the petitioner mentioning therein that responsibility for looking the aforesaid residential school was of the warden, namely, Sarita Kumari. The allotment to the school was made in the Bank account of Kasturba Gandhi Balika Residential School, Madanpur bearing Account No.30759578768 of SBI, Madanpur Branch and money was used to be withdrawn from the joint signature of Warden and this petitioner. The Warden was first signatory and petitioner was the second signatory. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. The petitioner is directed to surrender and make prayer for regular bail. The petitioner will be at liberty to produce necessary vouchers relating to expenditure done by him and other accused persons for purchase done in said financial year which will be considered by court below in
