That this writ application is directed for issuance of an appropriate writ in the nature of certiorari for quashing the part order which "the petitioner is not entitled to get the arrear as he has not worked in Civil Court. He has already received subsistence allowance and has been found guilty of negligence" passed in Departmental Enquiry No.01/2002 dated 08.04.2021 by Sri Dr. Ramesh Chandra Dwivedi, the District and Sessions Judge, Nalanda at Biharsharif and further for a direction to pay the entire salary excluding 75% subsistence allowance which has already been paid to the petitioner."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 08.04.2021, passed by the respondent no.4, by filing appropriate appeal. Liberty so sought is granted. 3.
