The petitioner is accused in connection with N.D.P.S. Case No. 01 of 2014 arising out of Simari P.S. Case No. 05 of 2014 registered under Sections 414, 420 of the Indian Penal Code, Sections 20(b)(ii)(c), 22, 27A and 29 of the Narcotic Drugs and Psychotropic Substance Act and Section 47A of the Bihar Excise Act.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected on merit vide order dated 22.09.2014 passed in Cr. Misc. No. 28088 of 2014 by this Court. It is further submitted that petitioner is in custody since10.01.2014.

Patna High Court Cr.Misc. No.40271 of 2015 (2) dt.02-09-2015 refused on merit taken into consideration the facts that the petitioner was sitting in the truck at the time of searching by the police, wherein 708.230 Kilograms of Ganja was recovered. No any fresh ground has been raised in the present petition to reconsider the prayer for bail of the petitioner. As such, I find no ground to reconsider the prayer for bail of the petitioner.
