JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner as well as learned counsel for the informant along with learned Additional Public Prosecutor.

Considering the nature of the allegation as well as submission having been made on behalf of respective learned counsels it looks appropriate to refer the matter to the learned lower court where petitioner is expected to file a petition supported with an affidavit showing his intention as well as readiness to marry with the informant and further, to keep her with full dignity and honour as his spouse. The petitioner will also assure the learned lower court that he will not subject the informant with cruelty, harassment nor will endanger her life.

In case such prayer is made, the learned lower court will release the petitioner on provisional bail in order to facilitate his undertaking and will keep watch till conclusion of the trial.
