JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Digha P.S. Case No. 109 of 2015 registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the first information report but his name came in this case in confessional statement of coaccused, Md. Aslam when the aforesaid co-accused was arrested in Alamganj P.S. Case No. 140 of 2015. The said co-accused disclosed the name of petitioner and several others and also stated about the role played by the petitioner in the present crime. It appears that except the aforesaid material, there is nothing against the petitioner. Moreover, having more or less similar allegation,

Patna High Court Cr.Misc. No.42692 of 2016 (3) dt.15-12-2016 2/2 co-accused, Md. Islam has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 24.05.2016 passed in Cr. Misc. No. 16036 of 2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Inam Khan, Judicial Magistrate 1st Class, Patna in Digha P.S. Case No. 109 of 2015 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
