2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 303(2), 3(5) and 87 of the BNS and under Sections 8 & 12 of the POCSO Act.
3. As per the F.I.R., all the named accused persons kidnapped the minor daughter of the informant with the
Patna High Court CR. MISC. No.56417 of 2025(3) dt.11-11-2025 2/3 intention of marrying her. The petitioner-accused are alleged to have assisted the main accused in fleeing away with the victim.
4. It is submitted on behalf of the petitioners that they are innocent and have been falsely implicated in the present case. The specific allegation of kidnapping has been levelled against the co-accused, Ravi Paswan. The petitioners have been arrayed as accused persons merely on the ground that they are family members of the said co-accused. The only allegation against them is that they allegedly assisted the co-accused, Ravi Paswan, in the commission of the alleged occurrence. Petitioners claim clean antecedent.
5. Learned counsel for the informant opposes the bail petition.
6. Considering the clean antecedent of these petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 6th District and Additional Sessions Judge-Cum-Exclusive Special Judge, POCSO Act, East Champaran, Motihari in connection with Harsidhi P.S. Case No. 365 of 2025, subject to the conditions
