JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.11.2013 in a case registered under section 394 of the Indian Penal Code. Petitioner is named in the first information report and the looted motor cycle was recovered when the petitioner and coaccused Kakku Mishra @Nityanand Mishra were going by the aforesaid motor cycle.

The co-accused Kakku Mishra @ Nityanand Mishra has already been granted privilege of bail by a Bench of this Court. So far as, criminal antecedent of the petitioner is concerned, it appears from Para-3 of the petition that three cases were registered against the petitioner on the same date i.e on 01.12.2012 and prior to institution of the aforesaid case, two cases had been registered

Patna High Court Cr.Misc. No.37733 of 2014 (3) dt.03-02-2015 2/2 against him in the year 2003-2005, respectively. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S.Case No. 164 of 2012.
