The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467 and 468/34 of the Indian Penal Code.

The prosecution case is that the informant participated in a quiz namely, 'Filmi Chehra Pahchano' and subsequently he received information that he won second prize, a Tata Indica Car. Subseqeuntly Raj Malhotra asked the informant if he wants to take cash money instead of Indica car he has to deposit processing charge, consequently, the informant deposited Rs.22,000/- in the account of Somnath Nandi. The petitioner is

Patna High Court Cr.Misc. No.35574 of 2015 (2) dt.20-08-2015 2/2 not named in the FIR. His name subsequently sprang up during investigation.

It is submitted by learned counsel for the petitioner that neither the petitioner is named in the FIR nor any money has been transferred in his account.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Gobardhana P.S. Case No. 12 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
