JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-01-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is in custody since 26.05.2014 for the offence punishable under Sections 498A, 304B and 34 of the Indian Penal Code.
It is submitted that the petitioner is the husband of the victim lady. Both of them were leading conjugal life happily and she had given birth of two children. Later on, the victim developed some mental problem and she left his house and ultimately, she was found near the railway track in dead condition. During investigation, it has been found that the victim jumped from the platform when the Rajdhani Express Train came and thus, she lost her life. After investigation, the charge sheet has been submitted for the offence punishable under Sections 498A and 306/34 of the
Patna High Court Cr.Misc. No.40253 of 2014 (3) dt.21-01-2015 2/2 Indian Penal Code. The petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in Gaya G.R.P. S. Case No.09/2014 with the following conditions : 1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
