JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bajpatti P.S. Case No. 04 of 2016 registered under Sections376/34 of the Indian Penal Code. There is allegation against the petitioner that he established physical relation with the informant on the false promise of marriage. The informant appears to be minor aged about 16 years and therefore, considering the facts and circumstances of the case as well as submission of the parties, I do not think it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected.
