ANJANA MISHRA ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 03.08.2016 in connection with Barauni P.S. Case No. 197/2016 registered for the offences punishable under Sections 406/420 of the Indian Penal Code. Considering the fact that the petitioner is not named in the First Information Report and his name has surfaced on the basis of suspicion and because one SIM which is said to be belonging to the father-in-law of the petitioner was found to have been used in the occurrence, the petitioner has been arrested. It is further submitted that the mobile phone was allegedly recovered from the possession of the petitioner. However, the articles alleged to have been stolen were not recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.42701 of 2016 (3) dt.21-11-2016 It is submitted on behalf of the petitioner that the alleged SIM was handed over to him by his father-in-law, but he was not aware of the fact that it was a stolen property. Considering the submission advanced by learned counsel for the petitioner and that the petitioner is not yet been put on Test Identification Parade, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 197/2016.
