JUSTICE PRABHAT KUMAR JHA ORAL ORDER 26-08-2015 Heard the learned counsel for the petitioner, the learned counsel for the complainant and the learned Additional Public Prosecutor.
The petitioner seeks bail in a case under Section 498A and other sections of the Indian Penal Code. The petitioner is the husband. The wife made allegation against the petitioner that he subjected her to physical and mental torture for non-fulfillment of demand of dowry. The petitioner was granted anticipatory bail on condition that he would pay maintenance and also keep his wife with him but the petitioner did not fulfill the condition. The petitioner surrendered before the
Patna High Court Cr.Misc. No.38112 of 2015 (2) dt.26-08-2015 2/2 court on 29.06.2015 and since then he is in jail. The learned counsel for the complainant submits that the complainant is ready to live with her husband. Considering the facts aforesaid and the fact that petitioner has already remained in jail for about two months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Siwan in Complaint Case No. 1519 of 2012 (T. R. No. 2565/15).
