====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 30-08-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Submission is that the FIR of the occurrence of dacoity is against unknown. Petitioners are in custody since 02.07.2018. Investigation of the case is already complete against the petitioners. They were never put on T.I. Parade during investigation of the case and nothing was recovered from possession of the petitioners. Co-accused Rajesh Kumar has already been allowed bail by a Coordinate Bench of this Court vide order dated 03.04.2019 passed in Cr. Misc. No. 20451 of 2019 (Annexure-2).

No.53642 of 2019(2) dt.30-08-2019 2/2 Finding substance in the submission, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 232 of 2019 arising out of Patrakarnagar Police Station Case No. 131 of 2018, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
