The petitioner seeks bail in connection with Jankinagar P.S. Case No. 366 of 2024 instituted for the offence under Sections 25(1-B)a, 26, 35 & 25(1-AA) of the Arms Act. 3.

On 12.10.2024, while checking vehicles at NH 107 near Vinobagram, police apprehended Amandeep Choudhary and Deepak Kumar, who attempted to flee on a motorcycle without documents. On interrogation, Amandeep confessed of being involved in illegal arms trade, supplying weapons from Suman Ram (petitioner) to gangs in Madhepura, Supaul, Saharsa, Purnea, and even Nepal, and disclosed that he had

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14-06-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Name of the petitioner has transpired on the basis of disclosure made by co-accused, namely, Amandeep Choudhary and Deepak Kumar and they have been enlarged on bail by this Court vide order dated 05-02-2025, passed in Cr. Misc. No. 88338 of 2024 and Cr. Misc. No. 44 of 22025. As is evident from bare perusal of the FIR itself that nothing has been recovered from the possession of the petitioner. Merely on the exculpatory statement of co-accused, petitioner has been roped in this case. Petitioner has no concern with the recovered arms. There is no compliance of Section 103 of the BNSS, 2023. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.61421 of 2025(2) dt.04-09-2025 3/3 of the case, period of custody of the petitioner, manner of petitioner's implication and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Jankinagar P.S. Case No. 366 of 2024.
