JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2018 The petitioner is apprehending his arrest in connection with Patliputra P.S. Case No. 186 of 2016, registered for offences punishable under Sections 406, 420, 379, 427/34 of the Indian Penal Code.
Allegation against the petitioner who happens to be the worker of Writer Safeguard Company and used to fill cash in the ATM and the allegation against him that he misappropriate Rs.4,79,900/-.
Submission of learned counsel for the petitioner is that there was responsibility of other employee of ATM and the petitioner has falsely been implicated in this case. Heard learned A.P.P. also who opposed the prayer for anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.43770 of 2018 (3) dt.16-08-2018 2/2 Having heard both sides, in view of the facts and circumstances of the case as well as in view of the nature of accusation, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail, which would be considered on its own merit.
