Petitioner apprehends his arrest in Barauli P.S. Case No.95 of 2018 instituted for the offence under Section(s) 341, 323, 324, 308 & 379/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate-XIV, Gopalganj.
In the written report, there is specific allegation against petitioner of giving Bhala (spare) blow in the left side of abdomen of informant, on account of which he sustained bleeding injury and fell down on the ground. The informant was sent to Primary Health Center, Barauli, for treatment from where he was referred to Sadar Hospital, Gopalganj, as injury was serious in nature.
The injury report was called for from the Court
Patna High Court Cr.Misc. No.42381 of 2018 (4) dt.30-08-2018 2/2 below, which has been received. The Doctor has found injury on right side of chest of the informant caused by sharp and hard weapon and the nature of injury was grievous. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- Rohit Kr.
