02. 21.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Section 47(a) of Bihar Excise Amendment Act.

It is contended that allegedly as per the First Information Report 90 litres of foreign liquor were recovered from the car which was boarded by three persons including the petitioner and looking the raiding party two others managed to escape whereas the petitioner was apprehended on spot. It is further contended that the petitioner is in custody since

Patna High Court Cr.Misc. No.42896 of 2016 (2) dt.21-10-2016 25.07.2016 and his antecedent is clean. It is also submitted that the charge-sheet has been submitted.

Having regard to the facts and circumstances of the case, the petitioner, namely, Rajesh Kumar @ Dara Singh is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Dehri-on-sone, Rohtas in connection with Excise Case No. 43 of 2016.
