The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 323, 324, 341, 379, 504 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that the eight named accused persons including the petitioner herein on being confronted by the informant as to why they were encircling his land, it is stated that they started to abuse him, snatched a gold chain and cash from his pocket and brutally assaulted him and his nephew causing serious injuries.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of land dispute between the parties. The allegations are

Patna High Court CR. MISC. No.68767 of 2021(2) dt.06-06-2022 2/2 general and omnibus in nature. There is case and counter case between the parties and the injury report does not support the allegations in the F.I.R. of assault by eight accused persons. The petitioner is in custody since 12.10.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the case and counter case between the parties, the allegations being general and omnibus in nature together with the petitioner having remained in custody for over 7 months, the Court directs the petitioner to be enlarged on bail in connection with Chhatauni P.S. Case no.284 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
