JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-09-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 2 of 2019 arising out of Pasraha P.S. Case No. 37 of 2019 for the offenses under Section 8/20 (b)(ii)(c)/26/29 of the NDPS Act.

In the instant case 81.600 Kg. Ganja was recovered. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and he is in custody since 31.03.2019. The petitioner is aged about 70 years. Considering the fact that the petitioner has no criminal antecedent and he is 70 years old, the court is inclined to grant bail to the petitioner subject to the condition that petitioner shall deposit Rs. 1,00,000/- cash in the court below

Patna High Court CR. MISC. No.56515 of 2019(2) dt.06-09-2019 2/2 and on deposit of cash of Rs. 1,00,000/- the court below shall release the petitioner, above named, on bail on furnishing bail bond of Rs. 1,00,000/-(One lac) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 3rd cum- Special Judge (NDPS), Khagaria in connection with Special Case No. 2 of 2019 arising out of Pasraha P.S. Case No. 37 of 2019.

The petitioner shall extend full co-operation in the trial and in the event the petitioner fails to attend the Court on two consecutive dates without any cogent reason, the court below shall be at liberty to cancel his bail bonds. The deposit of cash of Rs. 1,00,000/- shall abide by the final outcome of the criminal case.
