The petitioners are languishing in jail since 03.07.2015 in a case instituted under Sections 147, 148, 149, 307, 302, 427 and 435 of the Indian Penal Code.
It is alleged by the informant that on 18.12.2010 the informant was patrolling duty at Nityanand Chowk in the meantime he heard the sound of firing from the side of Chowk and saw that a truck was burning and a dead body was lying on the earth on the left side of truck cabin whose face was not identified as the entire body was burnt.
Patna High Court Cr.Misc. No.37541 of 2015 (3) dt.06-10-2015 It has been submitted on behalf of the petitioners that the petitioners are in custody since 03.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioners. There is no specific allegation made against the petitioners. General and omnibus allegation has been made against 100-150 persons. The co-accused have been granted bail by this Court vide Cr.Misc.No.48460 of 2014. On behalf of the State, it has been submitted that the petitioners are not named in the FIR and their names appeared in course of investigation.
Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Begusarai in connection with Cheriya Bariyapur P.S.Case No.12 of 2010.
