JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. A Mini gun factory is said to be unearthed from the house of the petitioner and it is alleged that two pistols and 18 live cartridges as well as other apparatuses, which are used in manufacturing the firearms, were recovered from the house of the petitioner. The wife of the petitioner was arrested on the spot whereas petitioner managed to escape from there. Submission on behalf of the petitioner is that petitioner voluntarily surrendered before the court below and is languishing in jail custody since 10.06.2016. It is further submitted that, as a matter of fact, nothing was recovered from the house of the petitioner and the police lodged this false case against the

Patna High Court Cr.Misc. No.42842 of 2016 (3) dt.25-11-2016 2/2 petitioner as the petitioner had been made accused in Ahiyapur P.S.Case No. 327 of 2010.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate,1st class, Khagaria in connection with Gogari P.S.Case No. 17 of 2016.
