The petitioner, being the mother of the husband of the victim is languishing in custody since 16.4.2019 in a case registered for the offences punishable under Sections 304B and 201/34 of the I.P.C.
The prosecution case is that the daughter of the informant namely, Mala Devi was married with the son of the petitioner and she was blessed with a male child but subsequently further dowry demand was made by the petitioner and other co-accused persons. It is further alleged that on 15.4.2019 the informant received information that her daughter has been killed and the dead body has been disposed of.
It is submitted by learned counsel for the petitioner that the victim caught fire accidentally and while she was being
Patna High Court CR. MISC. No.54831 of 2019(3) dt.20-11-2019 2/2 taken to the hospital, she died. It is further submitted that the thrust of accusation is against the husband of the victim. It is further submitted that the petitioner is a lady and the investigation has already been concluded. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
The learned APP, after going through the case diary, submits that there is specific accusation against the petitioner and she is named in the FIR.
Considering the nature of accusation, the petitioner being a lady, the fact that investigation has already been concluded, the period in custody and the petitioner is not having any criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM X, Muzaffarur in connection with Hathauri P.S. Case No. 72 of 2019.
