JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 This application, for grant of anticipatory bail, arises out of Raghunathpur P.S. Case No. 120 of 2019, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 1296 litres of foreign liquor from near the bridge and it is alleged that same belonged to petitioner and others.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and source of information has not been disclosed as to how the name of petitioner transpired in this case and during investigation, no incriminating material has come against the petitioner.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions judge -cum-Special Judge, Excise, Siwan, in connection with Raghunathpur P.S. Case No. 120 of 2019 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
