JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears from Para-9 of the petition that name of this petitioner came on the basis of information given by the spy of the police and thereafter, petitioner was arrested and made his confessional statement. No doubt, petitioner carries criminal antecedent but in the present case, except the aforesaid materials, there appears to be nothing against him. Petitioner is in jail custody since 28.04.2015 but up till now he has not been put on Test Identification Parade.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.36590 of 2015 (2) dt.31-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kuchhila P.S. Case No. 07 of 2015.
