JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 Petitioner seeks regular bail in connection with S.T. No. 190 of 2019, arising out of Kudhani P. S. Case No. 151 of 2012, registered for the offences punishable under Sections 302, 307, 324, 34 of IPC and Section 27 of the Arms Act. Earlier prayer for bail of the petitioner was rejected vide order dated 30.11.2018, passed in Criminal Misc. No. 68547 of 2018.

Allegation against the petitioner is of firing on the deceased, causing his death.

Submission of the learned counsel for the petitioner is that he is in custody for about 15 months and three witnesses have been examined and they have not supported the prosecution case but he has admitted that informant and I.O. has not been examined till date.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of bail to the petitioner.

Accordingly, this application is dismissed.
