The petitioner is aggrieved by the order dated 04.08.2012 passed by the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 528 of 2011 dated 30.10.2011 whereby cognizance under Section 7 of the E.C. Act has been taken and summons have been issued against the petitioner for facing trial.
After having heard the parties and taking into consideration the materials available on record as also the nature of allegation as disclosed in the F.I.R. vide Annexure-1, this Court does not any good ground to interfere with the impugned order taking cognizance of the offence.
The petition seems to be completely misconceived. It is, accordingly, dismissed.
However, the petitioner shall be at liberty to raise all the issues which have been raised in the present petition, during the course of trial.
