2. The petitioner seeks bail in connection with Ghoshi P.S. Case No. 154 of 2025 instituted for the offences punishable under Sections 126(2), 115(2), 109, 352, 351 (2), 3(5) of the BNS.
3. As per the prosecution case, while the informant was bringing the buffalow, the petitioner along with co-accused Kaushlendra Kumar starting abusing. In that course, petitioner tried to made firing by pistol on his temple and in the meantime, co-accused Kaushlendra Yadav assaulted on the head of informant by means of iron rod as a result of which he fell down on the ground.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.58247 of 2025(2) dt.27-08-2025 2/3 petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner and informant are agnates and there is ongoing dispute between the parties with regard to a tree. He further submits that there is specific allegation of assault against Kouslendra Yadav. Petitioner is in custody since 19.06.2025.
5. Learned APP for the State opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-X, Jehanabad dated 23.07.2025, it appears that petitioner is named in the FIR. It also appears that on the basis of written report of the informant namely Anil Kumar Yadav, FIR has been registered under Sections 126(2), 115(2), 109, 352, 351 (2), 3(5) of the BNS against two co-accused persons including the present petitioner It also appears that from perusal of the injury report which has produced on behalf of the petitioner in which the nature of injury is simple and the doctor has also found the injury, which is simple in nature, so considering all these aspects of the matter, I am inclined to grant bail to the petitioner.
7. Accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on
Patna High Court CR. MISC. No.58247 of 2025(2) dt.27-08-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Ghosi P.S. Case No. 154 of 2025.
