JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 12.07.2017 Heard learned counsel for the petitioner as well as learned Public Prosecutor for the State.

Petitioner was granted privilege of anticipatory bail vide order dated 31.3.2015 passed in Cr. Misc. no. 48009/2014 with direction to surrender before the Chief Judicial Magistrate, Gopalganj in connection with Mirganj P. S. case no. 64/2014 within four weeks from the date of receipt/production of the aforesaid order but petitioner wants modification of the aforesaid order on the ground that he was outside the State and could not get knowledge of order dated 31.3.2015 passed in Cr. Misc. no. 48009/2014 and as soon as he came to know about the aforesaid order, he went to the court below but he was informed that period of surrender has already lapsed and therefore, petitioner wants extension of period of surrender before the trial court in the light of order dated 31.3.2015 passed in Cr. Misc. no. 48009/2014 but I am not at all convinced with the aforesaid explanation because admittedly, order was passed for more than two years ago and the petitioner has come before this court for extension

Patna High Court Cr.Misc. No.32109 of 2017 (2) dt.12-07-2017 of period of time after more than two years of passing order dated 31.3.2015 passed in Cr. Misc. no. 48009/2014. Hence, this modification petition stands rejected.
