ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.07.2019 in connection with Andar P.S. Case No. 109 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made from the shop and not from the conscious possession of the petitioner. It is further submitted that the petitioner was taken into custody only because her husband was not there, the informant wanted to arrest the husband of the petitioner. The petitioner has no criminal antecedent.

Considering the aforementioned facts and
