The relief sought for by the petitioners, as mentioned in paragraph 1 of the present writ petition, is completely misconceived and untenable as nature of lands in question cannot be decided in a proceeding under Article 226 of the Constitution of India. Accordingly, the present writ petition is dismissed as devoid of merit.

However, the petitioners, if so advised, shall be at liberty to approach the civil court of competent jurisdiction for grant of appropriate relief with respect to lands in question as claimed by them.
