The writ petition was filed questioning the order of suspension and is rendered infructuous by the superannuation of the petitioner. Although some development has taken place in the matter and departmental proceedings have been initiated but then the petitioner would be at liberty to question the same in appropriate proceedings before the appropriate forum, if so advised.

Mr. Abhinav Srivastava, learned counsel appearing for the petitioner informs that the matter as regarding payment of retiral benefits is under consideration before the Hon'ble Chancellor and in view of such position, he seeks permission to withdraw this writ petition which is accordingly dismissed as withdrawn.
