The petitioner seeks bail in Shambhuganj P.S. case No. 94 of 2016 under Section 302, 120B, 34 of the Indian Penal Code.

The informant, of course, named the petitioner in the FIR, along with other accused persons, and suspected that petitioner and others might have killed his son on account of previous enmity as petitioner and others had threatened the son of informant to kill.

The learned counsel for the petitioner submits that save and except suspicion, there is no material in the entire case diary. Similarly situated accused, Subhash Singh, Bipin Singh and Vibhash Singh, have already been enlarged on anticipatory bail

Patna High Court Cr.Misc. No.43321 of 2016 (3) dt.15-12-2016 2/2 vide order dated 22.11.2016 passed in Cr. Misc. No. 43045 of 2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Banka in Shambhuganj P.S.
