The petitioner apprehends his arrest in Complaint case No. 279 of 2018 for the offences allegedly committed by the petitioner under Section 120B, 323, 341, 498A, 354B, 379, 504/34 of the IPC.
The learned counsel for the petitioner submits that petitioner is accused in Complaint case No. 279 of 2018 but due to typographical error in the order of the learned Additional Sessions Judge Complaint case No. 278 of 2018 has been typed. It is further submitted that petitioner is husband of the complainant. The marriage was solemnized 13 years ago. The
Patna High Court CR. MISC. No.55717 of 2019(2) dt.05-09-2019 2/2 petitioner never demanded any dowry nor ever subjected his wife to any sort of torture and the petitioner is a labourer. The complainant lodged the case on petty dispute. Taking into consideration the facts that the marriage was solemnized in the year 2005 and there is omnibus allegation of demand of dowry and torture, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Benipur, Darbhanga in connection with Complaint case No. 279 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
