This application for anticipatory bail arises out of Udwant Nagar P.S. Case N0. 147 of 2019, disclosing offences under Sections 304B and 201 of the Indian Penal Code.
The petitioner is the husband of the deceased. Marriage was solemnized nearly six years before the death of the deceased.
Learned counsel appearing on behalf of the petitioner has submitted that though there is specific allegation of demand of dowry but, as a matter of fact, she was suffering from acute appendicitis and died in course of treatment. He has also submitted that the informant has subsequently realized about the correct state of affairs and has filed a petition before the Court below, in
Patna High Court CR. MISC. No.55810 of 2019(2) dt.04-09-2019 2/2 this regard.
Be that as it may, considering the nature of allegation in the F.I.R, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Udwant Nagar P.S. Case No. 147 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
