Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 384, 385, 387, 307 of the Indian Penal Code. It is alleged that the petitioner, Sheru Ansari and 6-7 unknown persons came to the shop of informant and demanded extortion amount of Rs. 50,000/-. On nonpayment, the informant was assaulted and Rs. 26,000/- were taken away from the box of the informant.
It is submitted by the learned counsel for the petitioner that in the background of land dispute accusation has been levelled. Only one injury has been found to be grievous and others are simple in nature. The accusation is omnibus and general.
Patna High Court Cr.Misc. No.37005 of 2015 (2) dt.14-09-2015 It is submitted by the learned counsel for the informant that there is no land dispute between the parties and injury received by the informant is grievous. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sigori P.S. Case No. 33 of 2015, pending in the court of learned Sri Shyamal Kumar, Judicial Magistrate, Ist Class, Danapur, Patna.
With the above observation this application is disposed of.
