This application for anticipatory bail arises out of Kanti P.S. Case No. 482 of 2019 (O.P. Panapur) for the offence punishable under Section 37(a) of the Bihar Prohibition and Excise Act, 2016, and Section 25(10b)a of the Arms Act. On perusal of the First Information Report, I am satisfied that no offence under the provisions of Bihar Prohibition and Excise Act, 2016, is made out against the petitioner. Co-accused Chunchun Kumar was apprehended by the police, who was found in inebriated condition. The arms and ammunitions were also recovered from his possession. He is said to have disclosed petitioner's name as the person who had planted the said firearms.

Considering the nature of accusation against this

Patna High Court CR. MISC. No.54071 of 2019(2) dt.30-08-2019 2/2 petitioner, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur, in Kanti P.S. Case No. 482 of 2019 (O.P. Panapur), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
