JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No. 25 of 2016 registered under Sections 420, 406 and 409/34 of the Indian Penal Code. The accusation is that PCC work in between the house of Prince Pratab and Jibe Path in Navi Nagar and brick soling in between the house of Gopal Soni and Ramswarup Sah in Ward No. 9 was done but the quality of the work was below standard. The petitioner being the Assistant Engineer-cum-contractor of the work is responsible for substandard work and misappropriated of Government fund.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.49394 of 2016 (4) dt.02-02-2017 allegation is only to the effect that construction work of road as done under the supervision of the petitioner being the Junior Engineer was found not up to mark.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 25 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
