JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,188,323,353,427,447,448,436 and 337 of the Indian Penal Code and sections 3 and 4 of the Prevention of Damage to the Public Properties Act.
The prosecution case is that the FIR named accused persons along with 25-30 unknown came and set the old jeep and truck on fire and damaged the door and window of the office of the electricity department. The accused persons also took away revenue register and DCR book.
It is submitted by the learned counsel for the petitioner that for the same incident, one FIR was lodged by the Executive
Patna High Court Cr.Misc. No.37039 of 2015 (2) dt.14-09-2015 2/2 Engineer and the other by the Section Officer but narrations of both the cases vary. It is further submitted that the accusation is against the mob and except these two cases the petitioner is not accused in any other case and co accused Dayanand Tulsiyan has been granted anticipatory bail vide Cr. Misc. No. 30464 of 2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa Sadar P.S. Case No.178 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
