JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/188/353/427/447/448/436/337 of the Indian Penal Code and 3/4 of The Prevention of Damage to Public Property Act,1984.

Accusation is of entering into the electric supply office at Saharsa damaging the furniture and other articles. Six persons are named in the first information report.

It is submitted by learned counsel for the petitioner that for the same incident one FIR being Saharsa P.S. Case No.178 of 2011 was lodged by the Executive Engineer whereas the present case was lodged by sectional officer in 2011 but thereafter no process has ever been issued against the petitioner. No.36403 of 2015 (2) dt.10-09-2015 2/2 accusation is omnibus and general and similarly situated coaccused Abhimanyu @ Sonu Tulashyan has been granted bail vide Criminal Miscellaneous No.35972 of 2014 on 20.02.2015. Apart from the two cases the petitioner is not accused in any other case. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Saharsa P.S. Case No.179 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
