JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Paroo P.S. Case no. 153 of 2016, registered under Sections 341, 323, 326, 448 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 16.07.2016 at about 09.00 P.M., when the informant was going to sleep after taking his dinner. In the meantime, four persons, including the petitioners, and one unknown entered into his house by breaking the door. Thereafter, Deepak Singh shot fire causing injury on his left thigh and tried to again firing, but the same was passed over nearby temporal region. The informant, anyhow, succeeded to flee away from there and on raising hulla, the neighbours rushed there and accused persons fled away.

No.44518 of 2016 (2) dt.27-10-2016 2/2 Learned counsel for the petitioners submits that petitioner no.1 is the son of petitioner No.2 and they are next door neighbour of the informant, but due to ulterior motive the petitioners have falsely been implicated in this case and petitioners are said to be only the member of the mob without any overt act. Further submission is that though petitioners are accused in other cases, but they are on bail in all the cases.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Paroo P.S. Case No. 153 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J.) manish/- U T
