Petitioner happens to be husband of the deceased and is languishing in jail custody since 27-12-2014 in a case registered under Sections-113, 306, 498A/120(B) of the Indian Penal Code.
Admittedly, the deceased committed suicide by consuming poison and the charge sheet has already been submitted against the petitioner.
Learned counsel for the petitioner submits that the marriage of the deceased had taken place with petitioner in the year, 2000 and after that, the deceased gave birth to four children. It is further contended by him that in course of investigation, the
Patna High Court Cr.Misc. No.36296 of 2015 (2) dt.31-08-2015 2/2 statement of son of the deceased was recorded and the aforesaid witness stated that the deceased committed suicide in absence of the petitioner.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Tikapatti P.S. Case No. 135 of 2014 corresponding to Sessions Trial No. 267 of 2015 to the satisfaction of Learned Additional Sessions Judge-Ist, Purnea. (Hemant Kumar Srivastava, J) A.K.V./- U T
