The petitioner seeks bail in Basopatti P.S. Case No. 101 of 2018, instituted for the offence under Section(s) 392 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. No incriminating article has been recovered from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Pradeep Kumar @ Kalua @ Don and Ajeet Kumar Das who have already been granted bail by coordinate Benches of this Court vide orders dated 13.3.2019 and 18.4.2019 passed in Cr. Misc. 80430 of 2018 and 80333 of 2018 respectively.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Madhubani, in connection with Basopatti P.S. Case No. 101 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
