====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Guthani P.S. Case No. 166/2025 dated 15.05.2025 registered for the offences punishable under Sections 126(2), 115(2), 118, 117(2), 109, 191(2), 190, 303(2) and 351(2) of the B.N.S., 2023.
3. As per the prosecution case, the petitioner and the co-accused persons armed with lathi, farsa, iron rod, danda and pistol came and assaulted the informant, his son and his nephew with farsa, iron rod and from the point of pistol.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation of assault to the
Patna High Court CR. MISC. No.66054 of 2025(3) dt.18-11-2025 2/3 informant and his family members rather there is general and omnibus allegation against the petitioner and nine other accused persons. There is an admitted enmity and civil dispute between the parties. They are only members of the mob. There is case and counter case between the parties. The doctor has examined the informant and the injury report was kept by him. The petitioner has no concern with the alleged offence. It is further submitted that the other co-accused persons, namely, Rajdev @ Raju Ram, Dilip Ram @ Dilip Kumar Ram and Dhanu Ram @ Dhanoj Kumar Ram have already been granted anticipatory bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 66055 of 2025 vide order dated 12.11.2025. The petitioner has one criminal antecedent in which he is on bail as stated in paragraph no. 3 of the supplementary affidavit filed on behalf of the petitioner. The petitioner is in custody in this case since 16.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.66054 of 2025(3) dt.18-11-2025 3/3 the like amount each to the satisfaction of learned C.J.M. Siwan, in connection with Guthani P.S. Case No. 166/2025.
7. The application stands allowed.
