The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3(1) (i) (iii) (x) of the S.C./S.T.(Prevention of Atrocities) Act. Accusation is of abusing the informant by calling his caste name for non-accepting to do labour work. It is further alleged that accused persons assaulted and snatched Rs. 400/- from his pocket.

It is submitted by the learned counsel for the petitioner that Title Suit No. 292 of 2015 is pending between the petitioner and his agnates and who have set up the present informant to lodge the case. The brother of the petitioner had

Patna High Court Cr.Misc. No.36568 of 2015 (2) dt.10-09-2015 lodged informatory petitioner before learned Sub-Divisional Judicial Magistrate raising apprehension of false implication. For the occurrence of 11.05.2015 at 9.00 A.M. the First Information Report was registered on 12.05.2015 at 5.00 P.M. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate (Sadar), Motihari, East Champaran in connection with SC/ST (Motihari) P.S. Case No. 30 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
