1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that on account of land dispute his brother Jai Prakash assaulted him by an iron rod causing injury on head, thereafter Aman and Sahil assaulted informant's father Gauri Shankar by an iron rod causing injury on head, further when he fell, Sangita assaulted by knife causing injury on his back and thereafter all accused tried to strangulate Gauri Shankar and Jai Prakash snatched the chain of the informant worth Rs. 32,000/-.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant being wife of Jai Prakash who is own brother of the informant. It is further submitted that though it is alleged that petitioner assaulted the injured by knife, but then from perusal of the injury report of Gauri Shankar annexed as Annexure-2, it would manifest that all wounds are lacerated, it is next submitted that had Gauri Shankar been assaulted by knife, in that event the wound have been an incised wound. It is also submitted that petitioner has been falsely implicated in the case in order to coerce her husband into submission.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chiraiya P.S. Case No. 526 of 2024 subject to the conditions as laid down under

7. Accordingly, the instant anticipatory bail application stands allowed.
