JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case no. 484 of 2015, registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. The accusation is that Adharsh Kumar, son of Bhagawat Prasad Gupta submitted on-line Income Certificate in the name Md. Habib Ansari putting his forged signature.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, it has only come that this petitioner has hand into submitting the forged Income Certificate in respect of Md. Habib Ansari by Adarsh Kumar. The petitioner has no criminal antecedent. The co-accused Adarsh Kumar has already been granted Anticipatory Bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.44214 of 2016 (2) dt.21-10-2016 2/2 this Court vide Criminal Miscellaneous No. 19189 of 2016, dated 13.05.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 484 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
